A lawyer follows a professional code of conduct

A lawyer subject to professional rules that are laid down in professional code of conduct rules, the update and respect of which is guaranteed by the Association. These rules can be referred to at www.avocat.be

A lawyer is subject to the discipline of the Association to which he/she belongs.

If a lawyer breaches the professional code of conduct, a complaint may be lodged with the President of the Bar who will conduct an enquiry.

The President of the Bar then decides whether to refer the case to the disciplinary council (one disciplinary council per Court of Appeal jurisdiction). The lawyer and, under certain conditions, the complainant may be heard.

Sanctions delivered by the disciplinary counsel go from issuing a warning to banning, either temporary (suspension) or final (striking off), from practising the profession of lawyer.

The complainant reserves the right to bring the liability of his/her lawyer into question before ordinary, civil or penal courts.
